Terms of Service

These Terms of Service ("Terms") govern your use of JomForm at jomform.com (the "Service").

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you confirm you have authority to bind that company.

The Service is operated from Malaysia. You are responsible for compliance with local laws in your own jurisdiction.

JomForm lets you (the "Merchant") build order forms, list products (one-time or subscription), accept payments via CHIP, and manage sales.

The core Service is provided free of charge during the current launch period. We may introduce paid features later; we will always announce pricing changes before they take effect.

We may add, change, or remove features. If we discontinue a feature you rely on, we will give at least 30 days' notice.

You must provide a valid email address and keep your credentials secure.

You are responsible for all activity under your account, including activity by API clients or agents you authorise.

One person or legal entity per account. Do not share accounts between unrelated parties.

Payments on your forms are processed by CHIP. Your relationship with CHIP is governed by CHIP's own terms — you must maintain a valid CHIP account and keep your credentials accurate.

You are the seller of record for goods or services sold on your forms. You are responsible for product quality, delivery, refunds, chargebacks, and customer support for your own buyers.

You must comply with all applicable laws, including consumer protection, e-Invoicing (LHDN), PDPA, and BNM regulations.

Prohibited: illegal goods or services, gambling not licensed in Malaysia, adult content involving minors, malware, phishing, scams, counterfeit goods, weapons, drugs, and any activity that would put CHIP's or our compliance at risk.

We may suspend forms or accounts that violate this section, and will cooperate with CHIP and authorities on fraud investigations.

Buyer information collected on your forms (name, email, phone, orders) belongs to you as the merchant, and you are responsible for handling it lawfully.

You must provide your own privacy policy on your storefront or forms when required by law, and honour buyer requests (access, deletion, etc.) where you are the data controller.

We process buyer data only to operate the Service on your behalf.

Do not: abuse or disrupt the Service, attempt unauthorised access, scrape other users' data, send spam through our email systems, host illegal content, or bypass rate limits or security controls.

Public form traffic must comply with our rate limits (1 request/second, burst 10 per IP) — contact us if you need higher throughput for a legitimate campaign.

The Service (including code, design, and branding) is owned by JomForm. You keep ownership of your forms, content, and sales data.

You grant us a limited licence to host and display your content solely to operate the Service.

We aim for high availability but do not guarantee uninterrupted service. Maintenance windows are announced when possible.

Support is provided on a best-effort basis via email.

You may stop using the Service and delete your account at any time.

We may suspend or terminate accounts that breach these Terms, create legal risk, or remain inactive for a prolonged period (with prior notice where possible).

On termination we retain only data required by law, as described in the Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, except those that cannot be excluded by law.

To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (currently RM 0, as the Service is free).

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.

Nothing in these Terms limits liability that cannot be limited by law (e.g. for fraud or death/personal injury caused by negligence).

You agree to indemnify us against claims arising from your forms, your products, your violation of these Terms or of law, or your mishandling of buyer data.

These Terms are governed by the laws of Malaysia.

Disputes will be resolved in the courts of Malaysia, unless mandatory local consumer law gives you a different forum.

We may update these Terms. We will post changes with a new "last updated" date and, for material changes, give at least 14 days' notice by email.

Continuing to use the Service after changes take effect means you accept the updated Terms.
